Project specs appearing in January’s WisDOT letting will have some small, but important, additions that represent years of WTBA staff and member work.
WisDOT updated its Additional Special Provision-6 (ASP-6) this week to reflect compensatory utility delay language.
The changes come thanks to the Legislature and Gov. Tony Evers approving SB270, which WTBA helped craft and lobbied on behalf of.
Contractors will receive compensation for utility-related delays directly from WisDOT.
“Compensable delays are excusable delays due to the department’s actions or lack of actions,” the updated section states. The changes also added a fifth line of compensable delays as “the non-completion of work that utilities or other third parties perform, if that work is not completed as specified in the contract.”
